Normative Aspects of the Human Body


A Short Overview

Recent genetic research suggests we may soon change our genes to live longer healthier lives. These modifications would alter both our body’s normal shape and the usual way we obtain it. But all of society could suffer from even one person’s enhancements. So before we allow them, we must determine our collective valuation of the human body's integrity. This will tell us if individuals have the right to modify their genes.

But the body’s valuations have varied widely throughout humanity's rich cultural history. They range from God's image to the devil's instrument. And the ways people treat their body are just as various. Some punish it. Others treat it like a temple.

Some even choose to alter their body. There are many ways and reasons they do so. They use nutrition, drugs, and surgery. This alters its size, growth, and functioning. And they do this for religion, aesthetics, hygienics, medical health, and so forth. Some of these modifications deform the body. There are Indian parents who break their children's legs to make them more successful beggars.

Norms seem impossible when our valuations vary so dramatically. And are not autonomous citizens free to treat their body as they choose?

Siep disagrees. There are currently public debates aiming to decide every individual’s rights to abortion, euthanasia, self-mutilation, and gene therapy. And many of the ways we treat our body have negative consequences for other people. Even self-mutilations can burden the public's medical resources.

Or, consider positive consequences. Genetic changes could potentially spare future generations from considerable suffering. Thus we might be morally obligated to improve their genes. So consequences alone cannot ground our criteria. But norms could. That way we can know if individuals have the right to genetically alter the body they inherit or pass-on. Siep offers four reasons for why they do not.

Thesis 1. Many social rules follow from our body as it is. So if we change our body, we disrupt society’s order. Our bodies are holistic organisms. If you modify one part, you change the functioning of the whole. Likewise, all our genes work together holistically. Hence a change in one gene will alter the body's entire "shape" and functioning.

So those who improve their genes will differ vastly from everyone else. And they will be legally responsible for those advantages. A whole new category of laws would be needed to ensure that that modifications do not create injustice. This is one way that changes to the human body’s normal shape disrupts society’s structure and functioning.

Thesis 2. To take care of everyone's bodily necessities, society must distribute such goods as health care, food, and shelter to those in need. To do so on a wide scale, we must know how valuable certain things are for a normal human body. Otherwise there would be no basis to determine how to portion-out the goods to everyone.

Our long natural and cultural history has endowed us with our sense for what is valuable to normal human bodies. Society has come to depend-on our shared bodily heritage. So genetic changes will disrupt the orderly way we take care-of everyone’s bodies.

Thesis 3. Our genetic make-up is part of our common heritage. If we pass-on altered genes, then we deny future generations their right to participate-in humanity's long bodily tradition. Consider how we have inherited historical buildings, artwork, and natural landscapes. If someone were to damage any of these, they would be subtracting from everyone's common heritage. The public has the right to stop private owners from destroying human artifacts. Our normal body is perhaps our most precious one. So we can demand that no one genetically deforms it.

Thesis 4. We might soon have genetic technologies for protecting our descendents from hereditary diseases. But everyone has their own wish for how long they live. And some people value their mortality and bodily frailties. So we cannot force longer lives or perfect health upon future generations. But we do not need to value every terrible disease. Society must decide together which ones we should eliminate. But even then it is still better to let the next generations decide for themselves. This also means that parents should not make any changes to their children’s genetic make-up, although certain exceptional cases might be permissible. But to determine the exceptions we must establish what is normal.

IV. The Human Body as Common Heritage
and the
Justification of Its Alteration

(3) We have been speaking of the human body's common heritage. Siep wonders now what it would mean if we regarded the following also as belonging to this heritage:
a) the human species' genetic program
b) the species' random combination in heterosexual reproduction,
c) the range of phenotypic variety produced by this random reproduction.
And he wonders, what would the moral consequences be of regarding the human genetic program as part of our common human heritage?

Soon Siep will outline those consequences. But in genetic engineering there is also the issues of autonomy and paternalism. So first he will differentiate the degrees of this autonomy and paternalism. Today it is really not possible for someone to alter their own genes. But such technologies are pending. Some even predict that we are close to having genetic doping technologies for athletes. In these cases, one autonomously chooses to enhance one's own body. We should discuss the ethics of these near-future possibilities.

But genetic technologies will also allow us someday to alter the genetic properties of future human beings. This is one step further than the above instance of autonomous use. Presumably we would alter future humans' genes for their benefit. We might eradicate hereditary diseases or the genetic causes for aging. But there are paternalistic uses of genetic technology as well. Parents might engineer their child according to their personal wishes. Or perhaps even the state would enforce its wishes for our offspring by tampering with their genes.

Consider parents who have lived with their own hereditary diseases. They know best whether they should allow these genes be passed-on.

Our first case was autonomous enhancement. This seems to be a matter of informed consent. And some enhancements appear trivial and unnecessary. For example, someone might have their growth increased so that they can see better at a sports arena. But then if there were such people who made this decision, we might call for regulations to prevent them from interfering with other peoples' view. For example, rules could limit them to only the rear rows where they will be in no one's way. But of course we would not impose these rules on people who were born exceptionally tall, even though we think it is reckless when they insist on sitting in the front rows. The subtle but crucial difference is that the genetically altered people are tall by choice, and not by the contingent combination of parent genes. So they should live with the consequences of their decision. But those who are born that way cannot be blamed for their condition.

Another issue would be the inequalities that genetic enhancements would create. Consider if someone wanted an additional eye to have superior sight or more brain for a stronger intellect. Genetic modifications could create social competition. They could also increase the social impact of wealth and influence. So there are no private changes in the human genome. The consequences affect all of society. And if they do not, it is up to the person undergoing the alteration to prove that it will not damage public standards of fairness.

We attribute value to
1) the human heritage in the arts or historical buildings, and
2) the natural heritage of landscapes and species. (180bc)

So we value these human and natural heritages. Should we not also value the human body's "traditional" shape that we all naturally inherit? We preserve the integrity of historical buildings. For, we think people have a right to enjoy them as they have always been. So if we have a bodily heritage just as we have a cultural heritage, then we should also preserve our body's shape. People have a right to enforce the integrity of the human body, so that it is not destroyed like a blighted historical building or a despoiled natural landscape.

We are familiar with other people's bodily appearance. This allows us to trust in the constancy of their behavior. "And to whatever little degree we trust in humanity certainly also depends on what we know about human bodies." (180c)

Yet, we admit that the human body will inevitably change as humans adapt to new ways of living, nourishment, medicine, as well perhaps as communication and entertainment. Consider for example the music that entertains us. Most of it now is produced for electrically amplified sound systems. Siep says that our ears have become more tolerant to music's higher volumes. But these sorts of changes are not drastic. And they do not really change the human body so much. Rather, they support it by "technical insertions." And they enlarge the "realm of bodily variations and physical states." Nonetheless, the changes allow us to live a normal human life. And, we note something else about these changes. They do not come about by means of non-therapeutic single interventions in the body. "I think we have good reasons to regard the traditional genetic equipment of the human body and its contingent evolution as an important part of our natural heritage." (180d)

Siep has also mentioned paternalistic genetic interventions. They are related to his fourth thesis. So he addresses them in the following.

(4) These genetic advances seem like science fiction. And it probably does not matter if we can change one or two of our genes. Because there are probably many that are responsible for such qualities as our height, sight, organ production, and so forth. As well, even if we could change them, there would probably be unforeseeable risks. Thus it is not likely we will ever be able to change our body's major properties, at least not in a fully developed adult body. This would save us from dealing with the social consequences of genetic manipulation. But Siep says we cannot be certain.

There still are likely genetic advances on the horizon. For example, we probably will be able to protect our descendants from hereditary diseases. Just a step away from that is making genetic adjustments to protect us from illness and aging. Some scientists are certain these technologies will come. For, they have already declared our responsibility to block their implementation once they arrive.

Siep addresses two ethical questions involved in this use of genetic technology.
1) the question of paternalism and autonomy, which is a familiar debate in medical ethics, and
2) Siep's argument. Note first that we can consider the human body as a class or type of things. And we can consider specific instances or 'tokens' of bodies. Siep is speaking of the healthy human body both as type and token (class and instance). He says it it might represent an "objective value." If so, then it would seem that some diseases and bodily properties stand against this this objective value. So we would be right to protect people from such 'evils.' "At least since humanity expresses its feelings and convictions in prayers and poetry, sickness and death have always been wailed and cursed." (181bc)

We might say the same for ageing as we do for sickness. But there are ways to determine the worth of our longevity.
1) It depends on our body's "state of fitness" at that age.
2) Many people already have a diminished valuation for life after the mid-eighties, even if they would be in decent shape.
3) There would be social problems if
a) there are many people who are not dying, and
b) only a small part of the population can afford such genetic enhancement.

The "age pyramid" could deform. And there would be consequences if there is a slowing down of generation changes.

Siep will now address forms of paternalism that he finds justified. He believes it can be admitted only to treat serious diseases. And even then, we must be sure there will be no secondary effects. So we must use a very careful criteria. We find it difficult to precisely define health. Nonetheless, we must "respect the border between health and enhancement." "Only very serious and avoidable deficits regarding health can justify the appeal to objective interests of future persons." (182a)

So we will not treat non-serious illnesses. But does that mean we will treat none? Must we consider all aspects of the human body as equally valuable, whether it be health or illness? Consider certain religious people. They believe that sickness, suffering, and death are inherent to our body's existence. In fact, we should respect and dignify our human limitations. "Many virtues would disappear, if we were to eliminate these aspects of human life." (182b)

Nonetheless, religions have come to terms with medical advances and their implications for the human condition.

It would be too much ‘‘value conservatism’’, if we were to require the protection of the heritage of the human body including all the diseases we would otherwise be able to safely eliminate. (182bc)
So we do not need to preserve every human disease for the sake of maintaining the human body's heritage. Yet, it is also admirable when people cope with their own or with others' handicaps and diseases. Such limitations inhere to our bodies. So we may value them. But our efforts to overcome the body's health weaknesses are part of these values. The next generations will inherit these genetic frailties. It would be acceptable if they as a whole group decide to improve their genetic make-up. But we should not make this decision for them.

But we should better leave to the future heirs the risk of spoiling the good aspects by trying to remove the bad ones.(182c)
So also parents should not be allowed to change their children's genes, with the exception of "a very few clear cases." (182d) Nonetheless, many parents who suffer from such things as short stature think that their children would suffer too. But this is just an assumption.

To spare one’s offspring from the things one has been suffering from is a respectable but dangerous motive. (182d)
Siep is not referring to eugenics. Different people may have different valuations for genetic defects. So German law, for example, no longer allows abortion for the eugenic reason of sparing the child unbearable bodily handicaps. This way parents cannot impose on the child their beliefs for what sort of life is worth living. Yet, there are severe cases where genetic repair might be admitted. Only in these few very serious and clear cases should genetic intervention be allowed. In fact, it could be acceptable to change a child's genes in such a way that all his offspring (and their offspring) continue to pass-on the alteration (as would be the case in germ line thearapy). However, our current technology does suggest that we can make such changes without unwanted side-effects. And if we did develop that capacity, it should only be used for very clear cases of severe hereditary diseases. But if we want to identify a disease as such, we would first need a "rather stable concept of health and disease." To obtain such concepts, we need to establish what is normal for the human body "which we are familiar with." (183b)

So human bodies have a value aspect. Its ethical consequences are norms. These would "bind the genetic improvement of human beings/humanity to health purposes." (183c) To establish these norms, we need to determine the difference between health and severe disease. This requires a scientific and public discussion. In some countries, this will also require that governments employ genetic therapies for the sake of public health insurance. By establishing and upholding these norms, we could protect the human body's natural heritage. This will hold so long as no new genetic technologies develop which will raise additional ethical questions. If they do arise, then the public should again debate the human body's valuable aspects. Countries across the globe have rejected human cloning. This demonstrates the importance of the contingency of genetic combination in human reproduction.

The question of the permissibility of far-reaching changes of the human body are public questions, not simply the private affair of ‘‘free citizens’’ (183d)

III. The Human Body as Basis of Social Rules and Sources of Values



Previously Siep outlined his four theses. The first is that our body is a source of social rules. Hence changing our body will have social consequences. The second was that pleasure and pain tell us what other bodies need. He writes now that these two theses are "descriptive."

The third thesis is that the body has inherited a form shaped by our common heritage. We do not have the right to change it. The fourth thesis is that we cannot decide for future generations what their genetic make-up should be. He now explains that these last two theses deal specifically with the ethical problems involved in genetic enhancement. (174-175)

(1) Siep previously wrote that he would not take a position on the mind-body problem. But if we say that we may use our body, that suggests some degree of distance from it. But our body is largely who we are. And, our body itself tells us what many of our social rules should be. So if we change our body we will change our rules.

Some see the body as a mechanism. It has many different parts that may be isolated and replaced without changing the whole. They arrive at this belief by seeing how transplants and tissue engineering have enabled us to make therapeutic replacements. Siep acknowledges that there are mechanical parts that can be replaced. Yet, by doing so, we discover how each part integrates with the whole. Hence really these replacements only serve to demonstrate the body's indivisibility.

In fact, consider the brain and the genome. We cannot so easily replace parts of the brain without also thereby making drastic changes. Also, most genes are multi-functional, and they interact with the other genes. So we see that the brain and the genome are holistic systems.

So perhaps someone changes or enhances part of his body or genetic-make-up. But he thereby changes its "overall shape." So some suggest that we might make select changes to the human genome. Grave diseases could be eradicated. And certain limitations to our functioning could be lifted. But all the genes work together. Changing even just one could cause a domino-effect that changes the functional role of all the other genes. Later Siep will address the ethical consequences of such an outcome.

Our body has systems for integrating the organic parts, and for "steering" them. If we change their functioning, this could risk our body's integrity and health.

But consider also that we have certain rights that depend on our body's integrity and abilities. These traits also lie at the source of some of our values. Even small-scale interventions could change our body's integrity and its abilities to a considerable degree. That would then risk our social system and its regulations. For, they are based on those values we derive from our traditional body shape.

Siep explains with an example. He considers two crucial social values: equality and diversity. Nature does not create us all as equal. However, universal equality is a moral and religious idea. Siep says there are three cultural and natural conditions that allowed for this value:

1) Modern science has depicted human bodies as unequal. But they find that the differences are not enough to indicate that we cannot have legal equality. To think otherwise means holding far-fetched opinions. For example, one could believe that the noble classes' bodies pump another type of blood than the rest of us. Aristotle regarded "natural slaves" as being creatures who are between man and beast. Only with such unscientific beliefs might we find legal equality an absurdity.

2) The differences between our bodies are not drastic. And we are not responsible for those slight differences anyway. Instead we are responsible for our health and education. However, at one time people married those who could produce more beautiful or successful children. So in that sense it would seem that the differences in our bodies are important. Yet, now we base our marriages more on love. This will cause little change in our children's genetic make-up, certainly much less than what we would happen if we used genetic technologies to alter their genome.

3) We have a wide variety of social systems. Different bodily traits promote success in sports, business, politics, arts, sciences, religion, and so forth. Hence our third condition for legal equality: a variety of social systems which call for different natural dispositions. Bodily inequalities are more tolerable if they serve specialized purposes.

The variety of social systems results in part from the functional differentiation that developed throughout our social evolution. But the physical traits that make one person successful in sports are far different from those that lead to success in the sciences. But we do not reward people based on the same criteria in each social system. Instead, we must maintain a sense of justice so that the different traits are rewarded equally, even though they are different for each domain.

So the first condition for equality was that our bodily differences do not justify different legal treatment. The second is that we are not responsible for the bodies we inherit, or the bodies we pass-on to our offspring. On account of these first two conditions, two things become important for our "normative balance between equality and diversity:"

a) the body's traditional shape, and

b) the contingency of the body's genetic make-up.

If the wealthy or the powerful could enhance their genome, then some would be responsible for their own enhanced genetic constitution. This would undermine the foundation for the balance between equality and diversity. (177a)

Yet, some of us are luckier than others when it comes to our genetic inheritance. And the inequality of chance has not interfered with our legal and moral equalities. Also, most social inequality results from social injustice and not from differences in genetic luck. But because genetic differences are matters of chance, society may better tolerate genetic inequalities. "It takes the burden of justifying the distribution of chances off the shoulders of individuals and society." (177b)

Our social systems allow us to pursue happiness. The legal and moral equality of these systems is not obtained by enforcing overall equality. Rather, they presuppose that human bodes vary in their endowments, although to a limited extent. The differences result from chance, and not from individual or social planning. Social positions are distributed in part according to "lines of contingent variations of a 'rather equal' constitution of the human body." (177bc) As well, we distribute affection, sympathy, and admiration and so on according to the same bodily criteria. In other words, there are social norms that are based on the human body "as we know it." They would be altered if we change the body's genetic make-up. So we see that such a change is not just a personal issue. "It touches the basis of society." (177c) So the public together must thoroughly anticipate and evaluate the consequences of genetic manipulations.

(2) So there are differences between human bodies' natural faculties. But they remain within a certain limited scope. This has another social consequence. Society distributes valuable things, valuable events, valuable states of affairs, valuable goods, and so on. These are the means and conditions for many of our human values. Previously we noted the different ways society distributes these valuable things. In fact, there are two general ways society distributes them:
1) directly to individuals. These particular people require that the state provide for them or some other organization to do so, such as an international organization.
2) indirectly by establishing and maintaining such institutions as health care or education systems. These systems could be public. But they might be private also, or both. And they may also distribute their goods in some degree by means of markets. If the distribution is not so much governmental but rather in large part commercial, we still must provide a framework to determine the values for these products. We need to ask, what is heath? Education? The enjoyment of entertainment? The value of these commercial products always relates to the human body that either enjoys them or lacks them. (178a)

There are social, psychological, and mental components to the concept of health. Discussing them, however, will open another "Pandora's box." So Siep skips them for now. Instead he makes something clear: whoever provides people with valuable goods (be them social institutions or private producers) must follow some criteria for health, education, entertainment, and so forth. This criteria would be based on "a certain 'normal' constitution and state of the human body." (178b) The values we establish for the human body's integrity might allow varying degrees of enhancement. But without keeping in mind the body "as it is," we cannot easily imagine such things as its health, a good state of its nourishment, the development of its basic competences, and so on. So without such a notion of the body as it is, we cannot establish the criteria
a) for what is valuable to it, and
b) for what people can demand that society provide them.

In earlier times, society probably held a more limited range of possible values for the body. Before society may have scrutinized such sorts as ascetics, gourmands, sportsmen, lay people, and homosexuals. But today our broader array of values for the body considers them as treating their bodies in acceptable ways. But some people still do not have access to goods that are valuable to their body. So modern societies have developed procedures to distribute such goods as health and minimal nourishment required to sustain their bodies. Societies may go even further and furnish such goods as housing, clothing, and elementary education. But a criteria is needed for determining the values for those goods. "Thus an everyday, basically consensual, evaluative view of the human body is required even in modern 'individualistic’ societies." (178d)

There is another interesting related philosophical issue: whether we project this evaluative view onto the human body, or whether it is either one of the body's inherent qualities or one of its secondary qualities. Siep does not need to decide this debate to conduct his present inquiry. We only need to know that
1) there exists such an evaluative view of the human body, and
2) it results from a long natural and cultural history that spans to today.

Hence the body is not a "value-neutral natural object." Nor is it a tool for its owner's purposes. It has a 'general outlook.' This is its "natural heritage." Our modern societies and our values depend on this heritage. "To change it implies grave consequences for social values and norms. At least in this respect it has ‘normative aspects.'" (179a)

II: Evaluation of the Human Body

Through humanity's history, we have treated our bodies in a wide variety of different and opposing ways: as,
1) the prison of the human soul or the presence (Dasein) of human personality,
2) God's image or the devil's tool,
3) the source of vexation or the source of happiness.

Our body is made of flesh. In this way it belongs to the material world. Yet, our true spiritual essence does not belong to this world. In fact, our spirit longs to rid itself of its material confines. Hence "death is the best thing that a philosopher or a true believer can strive for." (172b) However, the body is also our source of pleasure. As such, it is the "abiding now" (nunc stans). Hence it is our only way of really achieving immortality.

Our bodies have a great variety of parts that together function harmoniously. Our organic nature has on-the-one-hand served as the standard for perfection in art and technique. But it is also what makes us "closer to worms than to any higher spiritual being." (172 bc) And according to one perspective, our organic harmony is viewed as a mirror image of the cosmos. So our body's organization should serve as a model for our human communities. But from another perspective, our body's organization can be seen as a "whimsical and insatiable tyrant enslaving the human mind and with its violent passions destroying all forms of human communities." (172c)

We see that in the very least, these above evaluations are based on certain metaphysical, moral, and religious presuppositions. Also, they are founded in different senses and uses of the term "body." In some cases it is metaphorical. And in others it is empirical. Or it could be biological, medical, philosophical, or poetic. So the meaning of "body" is not completely univocal. However, it is also more than mere word-play. (172d)

So there is a very wide diversity of ways that humans have conceived their body. And the ways we have treated our body is no less diverse and contradictory. Some have neglected or punished their bodies. Others have devoted their whole life to its beauty, health, or performance. (172-173) As well, many have altered their body in a great variety of ways and for a broad array of reasons. Some have influenced the growth or size of their body for the sake of religion, aesthetics, hygienics, medical health, or its instrumentation. Some means to do so are nutrition, natural and chemical drugs or poisons, directly cutting it, or mechanically changing its parts. Deformities have been no less important. There was a famous 18th century beggar who allowed people to use his hunchback for a writing desk. And some Indian parents have actively deformed their children's bodies by breaking their legs. They do so in order to prepare them for a life in begging. (173a)

So humanity has viewed and treated its body in a wide variety of ways. Hence it might seem that there is no good way to speak scientifically about its normative or evaluative aspects. But there is still one way to do so. We could examine how different cultures, religions, and philosophical perspectives have understood the nature and value of the human body. We could then consider the norms for the body's treatment which follow from its different conceptions.

But contemporary societies are pluralistic. And their citizens are autonomous. They have constitutional rights to conceive and treat their bodies any way they choose. So it seems that these cultural and traditional norms would not serve a contemporary ethics of the human body.

Sieb wonders. Really? Instead it seems our culture's evaluation of the body limits the ways we may treat it. We still debate abortion, euthanasia, sex-change surgury, self-mutilation, somatic gene therapy, and so forth. Although, in many cases other people's interests are involved. We might consider the embrio as an individual. Then it would have rights. And when people mutilate themselves, that might burden our medical insurance. And a doctor's moral beliefs factor-in when deciding to perform euthanasia. Also some conservatives hold normative views about what is natural in morality and law. For example, some conservatives hold that homosexuality is unnatural. So we see that altering our own body has consequences for others. This could ground a normative standard for how we can treat our body.

Things, however, are different now that we have the the potential to alter our genome. So it seems we cannot really base our normative ethics on issues regarding how others are affected. So for example, we would like to say that it is wrong to change the human genome. But doing so might not be much different from certain cultural traditions that alter our body. Nonetheless, it does seem that these enhancements will affect future generations. So in this way it does involve the interests of others. And perhaps that means we are entitled or even obligated to help future generations genetically. If so, we need to determine the criteria for evaluating the worth of given genetic programs. For this reason, we need to create an "evaluative view of the human body, which can generate norms." (174a) This is not a private matter. These genetic choices we make will be imposed on others.

Yet, we must distinguish two concerns:
1) the problems of permitting people to enhance their body or its genetic make-up, and
2) the criteria for how we can alter future generations' genetic constitution.

But both concerns share these common questions:
a) Is the human body merely an instrument of its owner's wishes?
b) Thus can the owner enhance it according to his desires?

Sieb says no. He offers four theses:

1) We must regard the body holistically. And the human body as a whole is the "basis and point of reference for our social rules." So if we change our body, this might have social consequences. It is a public task to anticipate and evaluate these possible changes.

2) Our body feels pleasure and pain on account of its feelings, performance, health, and beauty. This is the source for some of our values. They tell us what other humans need too. There are many types of people who are incapable of defending their interests, for example, the poor, the unborn, the future generations, and the handicapped. We can know that these other people too will have bodily needs like our own.

3) The human body has a "traditional shape." We should regard it as our common heritage. It's owner may not treat it as its property or as its tool.

4) We cannot assume that we know what the future generations will want and need. Hence we may not change this bodily heritage on their behalf. However, there could be some instances where we might save future generations from "expected heavy suffering." In those cases the public will need to debate the matter.

I: Introduction


Research in humanity's genetic make-up has advanced recently. Scientists have almost nearly determined all our species' genetic coding (the human genome). These findings suggest we could improve the genome. We might enhance our genes so that we may better resist diseases or live a longer life. So we can make alterations to the fundamental make-up of the human body. But this raises questions regarding the body's moral status:

1) Are we its embodied owner, and is it an instrument of our will?
2) Or does the public have the right to set limits to how we may modify our bodies?
3) Our bodies have traditionally taken a certain shape. Should we maintain that shape by maintaining our cultural traditions and our bio-diversity?
4) Does the body have a value beyond what its owner gives it?

Today medical ethicists debate the morality of bodily enhancement instead of its mere therapy. To take a position in this debate, we will need to answer the above questions. (171)

Siep will frequently refer to the "human body." But he does not presuppose that the mind-body relation is monistic or dualistic. However, we do have customary ways of referring to the relation we bear to our body. They suggest we might take some level of distance from it. So we might say that we can treat our body in one way or another. We might neglect it. Or we might cherish it. We could even rent or sell our bodies. So perhaps there is really a monistic relation between the mind and body. And thus our bodies treat themselves in these ways. And perhaps we are wrong to distance ourselves from the effects of these treatments. Yet, we can still distinguish our body from our job, our honour, or our rental contract. So such a monism would not subtract from the meaning of our question: how should we treat our body? Answering this question will produce criteria for what is the right and wrong way to do so. So it is also important for us to see the ways that our bodies relate to these criteria. (172a)

Abstract


Throughout its cultural history, humanity has ascribed the human body with a wide range of valuations, spanning from the image of God to the tool of the devil. Today we consider ourselves the owner of our body. It serves our wishes. And technology may make it more able to do so.

Siep objects. The human body bears a valuable "common heritage."

We need to maintain our modern social and legal order. To do so, it is essential that we preserve a particular understanding of the human body. It is a "normal" human body resulting from our natural and cultural history. But some might choose to alter their bodies through technology. Yet, this risks our sense of the body's normal condition. It would disrupt our social and legal order. Hence we should hold public debates regard the body's technical alteration so that we may make better common decisions regarding it. (171)
